Brussels Sets the Age at 15, Google Teaches Voice to Think, and Apple Eyes the Server Rack Again

Three stories from a week that was really one argument: who proves a machine is safe before it reaches you.

Three things landed this week that look unrelated and are not. A regulator in Brussels decided that platforms must prove they are safe for children before children reach them. Google shipped a voice model built to feel like a person is on the other end. And a report surfaced that Apple wants to sell the hardware that runs models like it. Read them together and they describe the same fault line from three sides.

1. The EU KIDS Act reverses who has to prove what

Regulation

What happened

On 17 September the European Commission adopted the EU KIDS Act — the acronym unpacks as "EU Keeping Internet Digital Spaces Accountable and Trustworthy" — a proposed Regulation on the protection of minors online. It does two separate things, and the second is the one that will matter.

The first is an age staircase. No social media account below 13. Between 13 and 15, a guardian sets up a limited account and stays in control: parental tools always on, contacts approved by the guardian, and a daily cap of at most one hour. From 15, a young person can open an account of their own — on services that are required by law to be safe for them. Crucially, the Commission states that self-declared age is explicitly not enough; access must be gated by certified age verification, and platforms have six months from the rules applying to check existing account holders and disable accounts belonging to under-15s or to anyone whose age cannot be established.

The second thing is safety by design, and it is most of the text. For minors, services may not use endless autoplay or infinite scrolling without real breaks, notifications engineered to pull a child back that relate to nothing the child did, rewards for posting to mass audiences, or streak mechanics that penalise a child for missing a day. Recommenders serving minors must be optimised for safety and mental health rather than engagement, with tracking-based personalisation off by default.

The age staircase, as written

Under 13
No account of any kind. One narrow exception: on video platforms built for young children, a parent may allow limited access through the parent's own account — no personalised feed, no search, parent-set daily limit of up to one hour.
13 to 14
Guardian sets up a limited account and keeps control. Parental tools always on. Contacts require guardian approval. Daily time limit of at most one hour.
15 and over
An independent account — but only on services that must, by law, be safe by design for minors. The obligations on the service do not switch off at 15.

Context

Two days before adoption, a leaked draft reported by Euronews was described as barring under-15s from social media without parental consent. The adopted proposal is a different shape: not a consent checkbox at 15, but a graduated ladder with a hard floor at 13. That distinction got flattened in a lot of the coverage, and it changes what compliance actually looks like.

The pressure behind it is national. The European Parliament called in November 2025 for a minimum age of 16. Portugal approved under-16 restrictions in February 2026. France has moved on under-15s. The Commission's stated reason for acting at EU level is blunt: the internet does not stop at borders, and a patchwork leaves a child protected in one country and not the next. Consequence

The enforcement architecture is where this stops being symbolic. Platforms with 45 million or more monthly active users in the EU cannot declare themselves compliant. Before their services come into contact with children under the new regime, they must file a detailed compliance plan and have it checked by independent auditors — paid for by the platform, not the taxpayer, with the Commission able to object to an auditor whose independence is not assured. Fines reach 6% of total worldwide annual turnover, and an expedited procedure applies to Commission-supervised services: preliminary findings within 30 days, a final decision targeted within 90.

AI companions are explicitly in scope. Chatbots reachable by minors may not use designs that simulate human relationships in ways likely to create emotional dependency. By default they may not carry a child's earlier conversations into later ones. They must be tested for risks to children before launch and monitored afterwards, and they cannot be placed on the market at all until the provider can demonstrate compliance. Under-13s reach them only through parental controls.

On privacy, the Commission is emphatic that age verification is not identity verification. The law requires zero-knowledge proof technology that cannot identify, locate, track or profile anyone, delivered through certified solutions independent of the platforms — a free EU age verification app now, the European Digital Identity Wallet later, and at least one free route in every member state including for people without digital ID.

What to watch next

This is a proposal, not a law. It now goes to Parliament and Council, and the single checkable milestone is whether 15 survives contact with a Parliament that asked for 16. After that: whether the free age verification app actually ships in all 27 member states, and how the six-month retroactive sweep of existing teenage accounts is handled by platforms that have never had to do it.

2. Gemini 3.8 Live: reasoning that speaks while it thinks

AI Models

What happened

On 15 September, Google introduced two live dialogue models — Gemini 3.8 Live and Gemini 3.8 Live Extended Thinking — in a post credited to Tom Ouyang and Malini Jaganathan on behalf of the Gemini Audio Team. The split is the story: one model tuned for scale and cost, one for tasks that need multi-step reasoning, both speaking in real time.

The numbers Google published for Extended Thinking: first place on Artificial Analysis' Speech to Speech Quality Index with a score of 82.6; 68.6% on the τ-Voice agentic benchmark; 35.1% on Sierra's τ-Voice-banking variant; and 97.7% on Big Bench Audio. The lighter 3.8 Live took second place in the Speech Agent Arena. Every one of those figures is Google reporting third-party benchmark results about its own model. We have not tested either model, and no independent replication was available at the time of writing.

The gap between the top and bottom bar is the honest summary: these models are excellent at understanding speech and considerably less reliable at finishing a real transaction by voice.

Context

Voice assistants have been stuck on a trade-off for a decade. Turn-taking punishes latency, so you either answer fast and shallow or think properly and leave the user listening to silence. Google's fix is presentational as much as architectural: Extended Thinking reasons and speaks simultaneously, using early verbal cues like "Let me check that…" and narrating multi-step background work as it progresses. It also executes tool and API calls in the background without stopping the conversation, and switches automatically between 97 supported languages mid-sentence.

The release cadence is worth noting on its own. Gemini 3.8 Flash arrived on 2 September, roughly three weeks after the previous release. This is a company shipping model branches faster than most enterprises can evaluate them — a point we made when the same pattern showed up in A Critical Threshold, a $12.93 Billion Commons, and Brussels' First AI Search Engine.

Consequence

Who gains: the voice-agent middle layer. Google names Agora, Fishjam, LangChain, LiveKit, Pipecat, Vercel and Vision Agents as platforms already building on the Live API, and Salesforce, Genspark and Lumeris among launch partners. Those companies sell the plumbing between a model and a phone line, and a better model makes their product better without them writing it.

Who should read the small print: anyone running a contact centre. A 35.1% score on voice banking tasks is not a product you hand an unsupervised customer account to, whatever the headline index says. Availability is uneven too — developers get both models through the Gemini API and AI Studio, enterprises a private preview in Gemini Enterprise, everyone 3.8 Live inside Search Live, while Extended Thinking reaches Gemini Live, Docs for Pro and Ultra subscribers, and Gmail and Keep for all Google AI subscribers. Generated audio carries a SynthID watermark.

What to watch next

Independent placement on the Artificial Analysis leaderboards, published by Artificial Analysis rather than quoted by Google, is the specific thing to check — and whether the τ-Voice-banking figure moves, because that number, not the index score, is what decides whether voice agents get trusted with money.

3. Apple reportedly wants back in the server business

Unconfirmed report

What happened

According to The Information, reported on 16 September, Apple is developing enterprise AI servers that it intends to sell rather than merely run itself. Two configurations are described: a smaller machine clustering two of Apple's planned M8 Ultra chips, and a larger one with four. Apple has reportedly considered linking those chips using NVLink Fusion, Nvidia's set of switches, chiplets and software for chip-to-chip communication inside data centres. The stated buyers are AI developers, businesses and governments. Nothing is expected to go on sale before 2029, plans are not finalised, and the report acknowledges the project could be cancelled.

Every sentence in that paragraph is a report, not an announcement. Apple has confirmed none of it. Bloomberg's Mark Gurman added a further wrinkle, suggesting the 2029 machine could use M7 Ultra silicon, while allowing that Apple may be developing M8 Ultra in parallel — meaning even the chip generation in the headline is unsettled.

Context

Apple left this market once already. Xserve, its rack-mounted server line, was discontinued in 2011. What changed since is not Apple's appetite for enterprise sales but the shape of the workload: people now cluster Mac Studios to run large models locally, because Apple silicon's unified memory gives an unusual amount of addressable memory per watt compared with stacking discrete GPUs and their separate VRAM. The demand demonstrated itself before Apple built anything — a pattern we traced in Apple Changes Hands, OpenAI Buys an Army of Macs, and the AI Boom Hits the Power Grid.

Consequence

If it ships, this is not a training machine and it would be a mistake to read it as an Nvidia challenger. The pitch would be inference with a very large unified memory pool in a modest power envelope — and sovereignty. The word "governments" in a reported buyer list is the tell: the market for AI hardware that runs models on your own premises, under your own jurisdiction, is growing faster than the market for anything that has to phone home.

The genuinely surprising detail is NVLink Fusion. A company famous for owning its whole stack considering Nvidia's interconnect is an admission that Apple's own fabric does not yet scale out across many chips in a rack. That is a narrower technical concession than the headlines suggest, and a more informative one.

What to watch next

The checkable milestone is not an Apple announcement, which is years away if it comes. It is Nvidia's NVLink Fusion partner list. Nvidia publicises those licensees; if Apple appears on it, the story is real, and it will appear there long before anything ships.

Our Read

The clause everyone will argue about in the KIDS Act is the age line. The clause that actually breaks new ground is the audit-before-access rule: a platform above 45 million EU users must file a compliance plan and have an independent auditor sign it off, at its own expense, before its service touches a child. That is the regulatory logic of pharmaceuticals and aviation — prove it is safe, then sell it — applied to software for the first time at this scale. It is a bigger shift than any number of years.

Which makes the timing with Google's announcement almost comic. In the same week Brussels wrote that chatbots reaching minors "may not use designs that simulate human relationships in ways likely to create emotional dependency", Google shipped a model whose entire selling point is that talking to it feels intuitive and collaborative, with verbal hesitation cues engineered in to make the pauses feel human. Those two sentences describe the same engineering work with opposite signs, and nobody has defined where the line falls. And note who absorbs the cost: Google and Meta can hire auditors. The European service with four million users and no compliance team cannot — which is how a child-safety law quietly becomes a market-structure law.

What we still don't know: whether 15 survives a Parliament that asked for 16; whether zero-knowledge age verification holds up at population scale rather than in a pilot; whether Google's benchmark figures replicate independently; and whether Apple's server exists in 2029 in any form at all.
